A loan is a large financial\ninvestment that has the potential to improve your life. Minorities, such as\nAfrican-Americans, women, and the economically disadvantaged have faced\ndiscrimination from lenders. They have been\nturned down based on who they are rather than based on their credit\nscore or credit history. But rules have been changed. With these changes, do\nlenders still discriminate against minorities in 2019? <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Fair Housing Act <\/strong><\/h2>\n\n\n\n<p>The <a href=\"https:\/\/www.hud.gov\/program_offices\/fair_housing_equal_opp\/fair_housing_act_overview\">US\nDepartment of Housing and Urban Development (HUD)<\/a> summarizes\nhousing discrimination under The Fair Housing Act as \u201c&#8230;illegal in nearly all\nhousing, including private housing, public housing, and housing that receives\nfederal funding.\u201d It protects people seeking to buy a home, applying for a\nmortgage and financing, applying for housing assistance, and more. The act\ndescribes all those who are protected\nagainst discrimination:<\/p>\n\n\n\n<ul><li>People of a different race<\/li><li>People of color<\/li><li>Different national origins <\/li><li>Different religions <\/li><li>A person\u2019s sex<\/li><li>If they are disabled<\/li><li>Familial status <\/li><\/ul>\n\n\n\n<p>The Fair Housing Act sets the\nlegal standards mortgage lenders must adhere to as well. It&#8217;s illegal for a\nlender to do the following to any person who falls under the protected list and\napplies for a mortgage or housing\nassistance:<\/p>\n\n\n\n<ul><li>Not provide the necessary\ninformation regarding loans <\/li><li>Provide different interest\nrates, fees, and terms and conditions on a loan&nbsp;\n<\/li><li>Refuse to make a mortgage\nloan <\/li><li>Not provide financial\nassistance residence <\/li><li>Discriminate in the\nappraisal of a residence<\/li><li>Refuse to purchase a loan <\/li><li>Add conditions to the availability of a\nloan when questioned about harassment<\/li><\/ul>\n\n\n\n<p>Additionally, a lender\ncannot intimidate, threaten or coerce anyone who is within their rights under <a href=\"https:\/\/www.justice.gov\/crt\/fair-housing-act-1\">The Fair Housing Act<\/a>.\nThey also can&#8217;t retaliate against any persons who have filed a complaint or\nlaunched a fair housing investigation. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Does Lender Discrimination Still Exist?<\/strong><\/h2>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"600\" height=\"387\" src=\"https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2019\/03\/Lender-Discrimination-of-Minorities-600x387.jpg\" alt=\"woman and loan application\" class=\"wp-image-356335\" srcset=\"https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2019\/03\/Lender-Discrimination-of-Minorities-600x387.jpg 600w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2019\/03\/Lender-Discrimination-of-Minorities-450x290.jpg 450w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2019\/03\/Lender-Discrimination-of-Minorities-900x581.jpg 900w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2019\/03\/Lender-Discrimination-of-Minorities-1400x903.jpg 1400w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2019\/03\/Lender-Discrimination-of-Minorities-2000x1290.jpg 2000w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2019\/03\/Lender-Discrimination-of-Minorities-300x194.jpg 300w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2019\/03\/Lender-Discrimination-of-Minorities-768x496.jpg 768w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><\/figure>\n\n\n\n<p>There have been patterns in\nthe loan denial for people of color nationwide. The patterns are based on a <a href=\"https:\/\/www.mcall.com\/news\/nationworld\/pennsylvania\/mc-nws-racial-discrimination-home-loans-redlining-20180214-story.html\">year-long\nanalysis conducted by the Reveal from The Center for Investigative Reporting<\/a>.\nThe U.S Department of Justice and the Federal\nReserve looked at 31 million records to\nidentify the lending differences between groups of people and individuals. They\nfound that denial rates for people of color were much higher than the denial\nrates for white people in 48 cities across the nation. <\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p>The DOJ and Federal Reserve found that denial rates for people of color were much higher than the denial rates for white people in 48 cities across the nation<\/p><\/blockquote><\/figure>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p>During the 1930s, discrimination was rampant. Redlining was a popular form of\ndiscrimination. Redlining is a systematic denial of a service to specific residents. Surveyors for the federal Home\nOwners&#8217; Loan Corp would draw on maps to mark areas where immigrants and\nAfrican-Americans resided. They would refuse to lend to these areas based on\nracial and ethnic factors. <a href=\"http:\/\/www.bostonfairhousing.org\/timeline\/1968-Fair-Housing-Act.html\">Redlining\nhas now been illegal since 1968<\/a> when the Fair Housing Act was passed. <\/p>\n\n\n\n<p><a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-and-consumer-financial-protection-bureau-reach-settlement-hudson-city\">In\n2015, the Consumer Financial Protection Bureau and the Department of Justice<\/a> accused a New Jersey bank,\nHudson City Bancorp, of redlining entire\nneighborhoods that mostly consisted of black and Hispanic residents. It spanned\nacross home mortgage lending services in Pennsylvania, Connecticut, New York, and\nNew Jersey. <\/p>\n\n\n\n<p>Many residents were\ncreditworthy and would have otherwise been\napproved for loans. The act of denial in these cases goes against The\nFair Housing Act that states lenders cannot refuse to make or purchase a\nmortgage loan. The case ended with a $33 million settlement because of unfair lending\npractices.&nbsp; <\/p>\n\n\n\n<p>In early 2018, the\nPennsylvania Attorney General launched a <a href=\"https:\/\/www.revealnews.org\/blog\/3-investigations-opened-after-reveal-uncovers-redlining-in-philly\/\">redlining\ninvestigation<\/a> in the Philadelphia area. Their findings concluded\nthat African-American borrowers in the area were 2.7 times more likely to have\ntheir home mortgage applications denied than white borrowers. <\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p>The Pennsylvania AG launched a redlining investigation that concluded that African-American borrowers in the area were 2.7 times more likely to have their home mortgage applications denied than white borrowers. <\/p><\/blockquote><\/figure>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p>It was also revealed that white applicants, despite having a closely-related population percentage, had\nreceived ten times more loans than black applicants. All this has contributed\nto the denial rate statistics that black people are far more likely to be\ndenied in 48 cities. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How to Prepare for a Loan Application <\/strong><\/h2>\n\n\n\n<p>There are ways for\nminorities to make sure they aren&#8217;t\ndiscriminated against when applying for a\nloan. The first step is to shop around at multiple lenders. It may reveal\na lender who offers rates that are much higher than the others- possibly due to\ndiscrimination. Shopping around can also help borrowers find the best deal. <\/p>\n\n\n\n<p>Understanding the rights that\nloan applicants have through federal, state, and local laws will help applicants\nknow if they are being mistreated. Other\nthan the Fair Housing Act, applicants should educate themselves about the <a href=\"https:\/\/www.ftc.gov\/enforcement\/statutes\/dodd-frank-wall-street-reform-and-consumer-protection-act-titles-x-and-xiv\">Equal\nCredit Opportunity Act and the Dodd-Frank Wall Street Reform and Consumer\nProtection Act.<\/a> While the laws\nare similar, different legislations dive deeper into mortgage lending and other\ntypes of loans. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Do You Suspect Discrimination?<\/strong><\/h2>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"600\" height=\"388\" src=\"https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2019\/03\/Lender-Discrimination--600x388.jpg\" alt=\"two women loan process\" class=\"wp-image-356334\" srcset=\"https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2019\/03\/Lender-Discrimination--600x388.jpg 600w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2019\/03\/Lender-Discrimination--450x291.jpg 450w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2019\/03\/Lender-Discrimination--900x581.jpg 900w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2019\/03\/Lender-Discrimination--1400x904.jpg 1400w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2019\/03\/Lender-Discrimination--2000x1292.jpg 2000w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2019\/03\/Lender-Discrimination--300x194.jpg 300w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2019\/03\/Lender-Discrimination--768x496.jpg 768w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><\/figure>\n\n\n\n<p>If you suspect you&#8217;re\nfacing discrimination, you can take several\nactions. The first step is to question the lender. Assuming you\u2019ve\nshopped around, you have an idea of what rates you\u2019ll get. Sometimes digging\ninto why you were denied may lead to a resolution. <\/p>\n\n\n\n<p>Legal steps you can take\ninclude contacting your state attorney general\u2019s office, hiring a local\nattorney or filing a complaint with the Department of Housing and Urban\nDevelopment or the <a href=\"https:\/\/www.consumerfinance.gov\/\">Consumer Financial Protection Bureau<\/a>\n(CFPB). <\/p>\n\n\n\n<p>Complaints should be filed within a year, but the sooner, the better. They launch an investigation after\nreceiving the complaint about the alleged\ndiscrimination. It\u2019s common for an investigation\nto conclude with a Conciliation Agreement or a Voluntary Compliance Agreement.\nHowever, based on the findings the organization may enforce the law which could\nland the case in federal courts. \n\nIt&#8217;s important to distinguish between denial that is based on discrimination and denial based on financial aspects such as\ncredit history. Some lenders do have stricter lending standards, and many do\nuphold the law.
