Information in the CARES Act can be hard to understand, so we\u2019re\nbreaking it down for you here, from credit reporting changes to credit\naccommodations and more. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Is Reported to the Credit Bureaus?&nbsp;<\/h2>\n\n\n\n<p>The law <a href=\"https:\/\/www.investopedia.com\/ask\/answers\/042715\/what-do-creditors-have-report-credit-bureaus.asp\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">doesn\u2019t require<\/a> lenders to report anything, but there are many pieces of information that lenders do typically report. This includes items like the following.<\/p>\n\n\n\n<ul><li>Payment history<\/li><li>Loans and loan terms<\/li><li>Balances owed<\/li><li>Account closures<\/li><li>Credit limits<\/li><\/ul>\n\n\n\n<p>In addition, things that appear in public records, like bankruptcies, usually show up on credit reports\u2014even if they are not explicitly reported by governmental agencies.<\/p>\n\n\n\n<p>All of these items have the potential to both positively and negatively affect your credit score, which lenders will use to determine whether or not to extend credit to you. So it\u2019s very important for you to be aware of what information is showing up on your credit report.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Adjustments to Negative Credit Reporting&nbsp;<\/h2>\n\n\n\n<p>As of March 27, 2020, negative credit reporting works a little differently. The CARES Act <a href=\"https:\/\/www.nolo.com\/legal-encyclopedia\/credit-protections-under-the-coronavirus-cares-act.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">modifies<\/a> the Fair Credit Reporting Act (FCRA) so that if you receive an accommodation for a loan due to coronavirus-related hardship and you were current on the loan prior to the accommodation, your creditor must continue to report your account as being current. This will help you protect your credit score from prominent negative items.<\/p>\n\n\n\n<p>Note that if your account was delinquent before the changes, <strong>it will remain delinquent<\/strong> unless you catch up on your payments. The CARES Act does not eliminate any preexisting items. You can still seek some kind of debt relief during this time, though.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Are Credit Accommodations?<\/h2>\n\n\n\n<p>Credit accommodations in the context of the CARES Act are loan modifications that your creditor can agree to grant you. These things are <a href=\"https:\/\/www.jdsupra.com\/legalnews\/the-cares-act-modifications-on-credit-71223\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">specifically listed<\/a>: <\/p>\n\n\n\n<ul><li>Deferring your payments<\/li><li>Letting you make partial payments<\/li><li>Forbearing any delinquent amounts<\/li><li>Modifying a loan or contract<\/li><li>Giving you any other assistance or relief <\/li><\/ul>\n\n\n\n<p>Whichever accommodation(s) you\u2019re given, it\u2019s important that you uphold your end of the deal with regard to making payments. Always get a written copy of the agreement so you know what your obligations and the lender\u2019s obligations are. You\u2019re likely to qualify for credit\naccommodations if you\u2019re a) a borrower and b) financially impacted by COVID-19,\nwhether that\u2019s due to a job loss, rising medical bills or something else. Contact\nyour lender as soon as you realize you are having trouble meeting your\nfinancial obligations.<\/p>\n\n\n\n<p>An important part of the text in the CARES Act is that the accommodation <a href=\"https:\/\/www.huschblackwell.com\/newsandinsights\/the-cares-act-modifications-on-credit-reporting-for-furnishers\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">must be by agreement<\/a>. This means that you need to discuss your specific circumstances with your lender and together decide on an arrangement that works; you should not stop making payments or make different payments without taking this step first.<\/p>\n\n\n\n<p>Such wording emphasizes the fact that this statute <strong>does not automatically block all negative reporting<\/strong>, which other proposals <a href=\"https:\/\/www.schatz.senate.gov\/press-releases\/schatz-brown-introduce-new-bill-to-protect-peoples-credit-scores-suspend-negative-credit-reporting-during-coronavirus-outbreak\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">attempted to do<\/a>. <\/p>\n\n\n\n<p>There were conflicting opinions on this, as certain members of the finance industry <a href=\"https:\/\/thehill.com\/opinion\/finance\/492267-covid-19-relief-bill-provisions-help-consumers-protect-their-credit-scores\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">worried<\/a> that this would ultimately hurt consumers more in the long run by weakening the accuracy of everyone\u2019s credit scores.  For now, borrowers have to rely on the provisions in the CARES Act and be proactive in caring for their financial health. <\/p>\n\n\n\n<p>For now, borrowers have to rely on the provisions in the\nCARES Act and be proactive in caring for their financial health.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to Negotiate with Your Creditor<\/h2>\n\n\n\n<p>Now more than ever, you need to know how to advocate for yourself and work with your creditors. Here are some things you can do, in many different situations, when negotiating with a lender: <\/p>\n\n\n\n<ul><li><strong>Ask about accommodations.<\/strong> Since the relief isn\u2019t automatic, you need to explicitly ask for assistance if you want it.<\/li><li><strong>Document all agreements and terms<\/strong>. Keep a proper record of everything, just in case.<\/li><li><strong>Have a natural disaster code added to your credit report. <\/strong>If you can\u2019t receive sufficient accommodations, this would be the next best thing. This code would <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.cnbc.com\/2020\/04\/02\/how-to-protect-your-credit-if-the-pandemic-affected-you-financially.html\" target=\"_blank\">indicate to potential creditors<\/a><a href=\"#_msocom_1\"> <\/a>that you were affected by a declared or natural disaster.<\/li><li><strong>Use pay for delete letters if necessary. <\/strong>These letters can help you when you want to remove certain negative items, like charge-offs and late payments, from your credit report.<\/li><li><strong>Challenge any preexisting negative items that you believe are inaccurate. <\/strong>You can do this in many ways, such as by using a <a rel=\"noreferrer noopener\" href=\"https:\/\/www.lexingtonlaw.com\/blog\/credit-101\/what-is-609-letter.html\" target=\"_blank\">609 Dispute Letter<\/a>.<\/li><li><strong>Above all, be honest and up-front. <\/strong>This will ensure that your creditors have as much accurate information as possible when considering if they will help you and how they can do so.<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"6251\" height=\"2718\" src=\"https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2020\/07\/BlogPost-Images_CRD_329503_Illustrated-Quote1-1.png\" alt=\"Make sure to ask your creditor about accommodations.
