This important because it provides an overview of the most common consumer complaints and makes it easier to identify trends.<\/p>\n\n\n\n<p>The CFPB is a government agency tasked with protecting consumers from unfair or deceptive practices in the financial industry as well as helping consumers understand the financial marketplace. <a href=\"https:\/\/files.consumerfinance.gov\/f\/documents\/cfpb_fcra-611-e_report_2022-01.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">This year\u2019s report<\/a> focuses on how NCRAs have recently failed to respond to consumer disputes in alarming numbers.&nbsp; This matters because inaccurate items on credit reports can have very negative consequences for those affected.<\/p>\n\n\n\n<p><a><\/a>Read on to learn more about what disputes are, why a dispute may not be resolved successfully and what options you have if you need to remove inaccurate items from your credit report.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-are-disputes-and-why-are-consumers-making-them\"><a><\/a>What are disputes and why are consumers making them?<\/h2>\n\n\n\n<p>When consumers find incorrect information on their credit reports, they can <a href=\"https:\/\/www.creditrepair.com\/education\/reports\/how-to-dispute-a-credit-report\" target=\"_blank\" rel=\"noreferrer noopener\">file a dispute<\/a> with the three major credit reporting agencies to potentially get the information taken off of or modified in their credit reports. This can often have a positive effect on a consumer\u2019s credit score.<\/p>\n\n\n\n<p>The Fair Credit Reporting Act (FCRA) requires each NCRA to conduct a \u201creasonable investigation\u201d if a consumer disputes the accuracy or completeness of the information in their credit file. Below are just a few examples of inaccurate information that may appear in a credit report:<\/p>\n\n\n\n<ul><li>Closed accounts reported as open<\/li><li>On-time accounts reported as late<\/li><li>Incorrect account balances<\/li><li>Incorrect credit limits<\/li><li>The same debts listed more than once<\/li><\/ul>\n\n\n\n<p>Consumers also file complaints when NCRAs don\u2019t remove outdated negative information as required. For example, some items are supposed to be removed after seven years, including late payments. If a late payment is still on a consumer\u2019s credit report after 10&nbsp; years, the consumer might file a dispute with the NCRAs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-are-the-disputes-being-handled\"><a><\/a>How are the disputes being handled?<\/h2>\n\n\n\n<p>The disputes are in many cases not being handled well. According to the CFPB annual report, the NCRAs are not responding to consumers\u2019 disputes or addressing the incorrect information on many consumers\u2019 credit reports. The number of consumer complaints to the CFPB against the NCRAs increased sharply in 2021, and these complaints accounted for <a href=\"https:\/\/files.consumerfinance.gov\/f\/documents\/cfpb_fcra-611-e_report_2022-01.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">nearly 60 percent of all complaints<\/a> submitted to the CFPB.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1500\" height=\"700\" src=\"https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2022\/02\/2.png\" alt=\"The number of consumer complaints to the CFPB against the NCRAs increased sharply in 2021, and these complaints accounted for nearly 60 percent of all complaints submitted to the CFPB.\" class=\"wp-image-361372\" srcset=\"https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2022\/02\/2.png 1500w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2022\/02\/2-300x140.png 300w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2022\/02\/2-600x280.png 600w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2022\/02\/2-768x358.png 768w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2022\/02\/2-450x210.png 450w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2022\/02\/2-900x420.png 900w, https:\/\/www.creditrepair.com\/blog\/wp-content\/uploads\/2022\/02\/2-1400x653.png 1400w\" sizes=\"(max-width: 1500px) 100vw, 1500px\" \/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-why-disputes-may-not-get-addressed\"><a><\/a><a><\/a>Why disputes may not get addressed<\/h2>\n\n\n\n<p>Many consumers\u2014<a href=\"https:\/\/files.consumerfinance.gov\/f\/documents\/cfpb_fcra-611-e_report_2022-01.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">in excess of 70,000<\/a>\u2014reported that their disputes with the NCRAs aren\u2019t being addressed in a timely manner. Here are a few reasons this might be the case:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-1-heavy-workload\">1. Heavy workload<\/h3>\n\n\n\n<p>The FACT Act, FCRA and Dodd-Frank Act are all designed to protect consumers, but it takes a lot of time, energy and money for the NCRAs to comply with these laws. In some cases, disputes aren\u2019t addressed in a timely manner because an NCRA doesn\u2019t have enough staff to review complaints or update consumer information in their systems. Staff may also be busy answering telephone calls or performing other duties, leaving them less time for responding to CFPB complaints.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-2-automated-system-glitches\">2. Automated system glitches<\/h3>\n\n\n\n<p>Another reason disputes aren\u2019t addressed in a timely fashion is because automated systems can be faulty. We rely on technology for almost everything, but it doesn\u2019t always work perfectly. Employees of an NCRA may have trouble accessing disputes or may not be able to respond due to network connectivity issues or problems loading disputes in their systems.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-3-difficulty-communicating-with-data-furnishers\">3. Difficulty communicating with data furnishers<\/h3>\n\n\n\n<p>NCRAs rely on data furnishers\u2014the credit card companies, banks and other financial firms responsible for reporting account information\u2014to respond to their queries quickly. For example, if a consumer files a dispute stating that an NCRA is reporting a late payment on an account that\u2019s never been late, the NCRA must contact the data furnisher and ask for more information.<\/p>\n\n\n\n<p>If the data furnisher doesn\u2019t respond in a timely manner, the NCRA can\u2019t respond to the complaint effectively. Additionally, the NCRAs receive data from more than 10,000 data furnishers, resulting in a significant amount of back-and-forth communication.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-4-disputes-submitted-by-representatives\">4. Disputes submitted by representatives<\/h3>\n\n\n\n<p>The CFPB report also found that NCRAs are not responding properly to disputes submitted by consumer representatives. Instead, NCRAs are allowed to respond via an administrative process.<\/p>\n\n\n\n<p>This process doesn\u2019t require an NCRA to provide a substantive response to the consumer. Instead, consider these options:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-file-disputes-with-the-ncras-yourself\">File disputes with the NCRAs yourself<\/h3>\n\n\n\n<p>You can file a dispute with the NCRAs yourself, if you prefer. You can file a report online, though sending your dispute via certified mail creates a paper trail, making it easier to prove the NCRA received it.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.creditrepair.com\/education\/reports\/how-to-dispute-a-credit-report\" target=\"_blank\" rel=\"noreferrer noopener\">Your dispute letter<\/a> should describe the error and explain why it\u2019s incomplete or inaccurate. It\u2019s also best to include supporting documentation. For example, if a credit card company is reporting that you have a $2,500 balance on an account that has a $0 balance, you may want to provide a copy of your most recent statement showing that you don\u2019t owe the company any money.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-work-with-a-credit-repair-company\">Work with a credit repair company<\/h3>\n\n\n\n<p>The dispute process can be stressful, especially if you\u2019re dealing with identity theft and have to file multiple disputes with all three NCRAs.
