Here are the most common types of zombie debts:<\/p>\n\n\n\n<ul><li><strong>Time-barred debts:<\/strong> These are unpaid debts that have passed the statute of limitations (which varies from state to state).<\/li><li><strong>Debts no longer on your credit report:<\/strong> Unpaid debts disappear from your credit report after seven years, but not from your lender\u2019s ledgers.<\/li><li><strong>Settled debts:<\/strong> You and your lender agreed to settle through partial or full loan forgiveness, bankruptcy or another agreed-upon option.<\/li><li><strong>Debts incurred via identity theft:<\/strong> If your identity is stolen, it could be used for making purchases or taking out lines of credit without your consent or knowledge.<\/li><li><strong>Record-keeping errors:<\/strong> Creditors regularly buy and sell old debts. The more a debt changes hands, the more chances there are for records to get lost or mixed up.<\/li><li><strong>Debt buyer ploys:<\/strong> Debt buyers can purchase uncollected debts for cheap and try to collect or kick-start old payments from debtors.<\/li><li><strong>Forgotten debts: <\/strong>If you\u2019ve moved, changed names, updated contact information or just plain lost track of payments, you could forget about a debt entirely.<\/li><\/ul>\n\n\n\n<p>The general theme here is that a zombie debt is a debt you either thought had been paid off or didn\u2019t know about. Zombie debt is typically not something you should legally have to pay, but there are cases in which you could be responsible for past debts.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-do-you-have-to-pay-zombie-debt\"><a><\/a>Do you have to pay zombie debt?<\/h2>\n\n\n\n<p>Unfortunately, there is no hard-and-fast rule when it comes to paying zombie debts. In many cases, these debts are no longer valid. But in some cases, you could still be on the hook for overdue payments. Debt collectors have a few tactics for collecting each type.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-as-legitimate-debt\"><a><\/a>As legitimate debt<\/h3>\n\n\n\n<p>Zombie debts typically start out as funds you legitimately owed. If you settled a <a href=\"https:\/\/www.creditrepair.com\/education\/reports\/deliquent-accounts\" target=\"_blank\" rel=\"noreferrer noopener\">delinquent account<\/a>, for example, a collection agency might still try to get you to continue payments. This could be because they bought your settled debt or because of incomplete records. In this case, you likely shouldn\u2019t pay it because you\u2019ve already settled that debt.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-as-illegitimate-or-fraudulent-debt\"><a><\/a>As illegitimate or fraudulent debt<\/h3>\n\n\n\n<p>Some zombie debt, on the other hand, comes about by error or as a malicious attempt to get you to pay debts you never owed to begin with. This could be caused by shoddy record-keeping or\u2014as is all too often the case\u2014by unscrupulous or even fraudulent debt collection tactics.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-is-zombie-debt-legal\"><a><\/a>Is zombie debt legal?<\/h2>\n\n\n\n<p>You may be surprised to learn that zombie debt isn\u2019t necessarily illegal. Even if you\u2019re no longer liable for the debts in question, debt collectors are allowed to ask you to pay them\u2014they just can\u2019t sue you for them. Even if the debt was established through illegal means (like identity theft), a collection agency can still try to collect it.<\/p>\n\n\n\n<p>If a collection agency is pestering you about debts you\u2019re no longer liable for, however, the <a href=\"https:\/\/www.creditrepair.com\/education\/counseling\/fdcpa-statute-limitations\" target=\"_blank\" rel=\"noreferrer noopener\">Fair Debt Collection Practices Act<\/a> (FDCPA) has you covered. Under the FDCPA, agencies have to stop contacting you about time-barred, paid or otherwise settled debts if you tell them to stop.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-when-the-statute-of-limitations-applies\"><a><\/a>When the statute of limitations applies<\/h3>\n\n\n\n<p>The statute of limitations is a big piece of the zombie debt puzzle. Essentially, if a debt has passed a certain time threshold, you\u2019re no longer required to pay it. This length of time <a href=\"https:\/\/www.lexingtonlaw.com\/blog\/negative-items\/statute-of-limitations-on-debt-collection-by-state.html\" target=\"_blank\" rel=\"noreferrer noopener\">varies from state to state<\/a> but is generally between three and six years. The shortest is two (for oral agreements in California), while the longest is 20 (for promissory notes in Maine).<\/p>\n\n\n\n<p>If your debt has passed the statute of limitations, that doesn\u2019t necessarily mean it\u2019s been forgiven or erased. That just means you can\u2019t be taken to court over it, meaning you\u2019d have little incentive to continue paying. But if you make one single payment at that point, the timeline resets and you could then be taken to court over nonpayment.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-how-zombie-debt-affects-your-credit-score\"><a><\/a>How zombie debt affects your credit score<\/h3>\n\n\n\n<p>Missed payments hurt your credit score\u2014and lots of missed payments can <em>really<\/em> hurt it. The good news is that your credit report only tracks debts for up to seven years. Once unpaid debts hit that mark, they\u2019re no longer recorded. When you do need to pay for something on credit, establish a <a href=\"https:\/\/www.creditrepair.com\/blog\/credit-101\/how-to-pay-card-bill\/\" target=\"_blank\" rel=\"noreferrer noopener\">realistic payment plan<\/a> and follow through with it until it\u2019s paid in full.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-protect-your-personal-information\"><a><\/a>Protect your personal information<\/h3>\n\n\n\n<p>As noted above, zombie debt can be caused by identity theft. Keep your personal information secure with tactics like two-factor authentication, randomized passwords or\u2014at the very least\u2014simply refusing to share it with people or websites you don\u2019t trust.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-monitor-your-credit\"><a><\/a>Monitor your credit<\/h3>\n\n\n\n<p>Stay on top of inconsistencies in your credit report by checking it regularly. You could even enroll in <a href=\"https:\/\/www.creditrepair.com\/blog\/credit-score\/monitoring\/\" target=\"_blank\" rel=\"noreferrer noopener\">credit monitoring services<\/a> that automatically update you when your personal information is exposed or when your credit changes for any reason.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-keep-a-record-of-your-debts\"><a><\/a>Keep a record of your debts<\/h3>\n\n\n\n<p>Whether you\u2019re actively making payments or are having trouble keeping up, don\u2019t let your debts slip away from you. Attempting to wait out the statute of limitations isn\u2019t an effective strategy, so keeping a careful record of what you owe will help make sure you don\u2019t get an unexpected call from a collection agency.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-be-wary-of-debt-collectors\"><a><\/a>Be wary of debt collectors<\/h3>\n\n\n\n<p>If you\u2019re contacted about a debt you\u2019ve forgotten about\u2014or didn\u2019t even know about\u2014don\u2019t share any personal information. It could be a debt shark trying to get you to start paying zombie debts you\u2019re not liable for. Legitimate collection agencies will have all your necessary information and shouldn\u2019t have to ask you for it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-creditors-have-contacted-you-about-zombie-debt-what-now\"> Creditors have contacted you about zombie debt\u2014what now? <\/h2>\n\n\n\n<p>It can come as a shock to get an email, letter or phone call from a debt collector claiming you owe past due funds. If you do, first and foremost, don\u2019t panic. If they\u2019re trying to collect zombie debts, there\u2019s a good chance you don\u2019t need to do anything at all.<\/p>\n\n\n\n<p>Remember to not communicate anything with debt collectors unless you\u2019re absolutely sure the claims\u2014and agency\u2014are legitimate. Your next move will depend on whether you recognize the debt and, if so, whether you\u2019ve already paid or settled it.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-to-do-if-you-recognize-the-debt-but-haven-t-paid-it\"><a><\/a>What to do if you recognize the debt but haven\u2019t paid it<\/h3>\n\n\n\n<p>If you recognize the debt and it\u2019s past your state\u2019s statute of limitations, the collector may have no leverage to require you to pay. Consider reaching out to an attorney or other qualified professional to make sure. Send them proof of your payment (if you have it) and ask them to stop calling or writing to you. If they continue, file a complaint with the <a href=\"https:\/\/www.ftc.gov\/faq\/consumer-protection\/submit-consumer-complaint-ftc\" target=\"_blank\" rel=\"noreferrer noopener\">Federal Trade Commission<\/a> (FTC).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-to-do-if-you-don-t-recognize-the-debt\"><a><\/a>What to do if you don\u2019t recognize the debt<\/h3>\n\n\n\n<p>If someone is trying to collect on a credit line you never took out, there\u2019s a good chance it\u2019s due to identity theft\u2014or even a scam by the person contacting you. Check your credit report, close any accounts you didn\u2019t open yourself and file a report with the FTC via <a href=\"https:\/\/www.identitytheft.gov\/\" target=\"_blank\" rel=\"noreferrer noopener\">IdentityTheft.gov<\/a>. You may want to freeze your credit as well.<\/p>\n\n\n\n<p>We know zombie debt can seem scary, but you can make sure it doesn\u2019t turn your life into a horror movie by following the precautions above. In most cases, these debts are either no longer your responsibility or never were to begin with.<\/p>\n\n\n\n<p>Now that you know what zombie debt is, you can make an informed action plan if a collection agency pops up asking for money.
